Guided wine purchases
Lay & Wheeler and its Agents will use their best endeavours in recommending wines suitable for investment. Responsibility for authorising purchases and sales, including acceptance of the price, remains with you.
Use of historical information
Lay & Wheeler provides confidential information it has gathered on the past performance of wine prices for the sole purpose of assisting you in the formulation of your wine buying strategy. This information has been obtained using its best endeavours, however, Lay & Wheeler accepts no responsibility for detrimental consequences arising from errors or omissions.
Payment of fees
By entering into a Lay & Wheeler Vintage Assets Programme® contract you are deemed to accept Lay & Wheeler’s terms including the payment of annual fees, commission on sales and cellarage charges. Wines purchased remain the property of Lay & Wheeler Limited until all invoices and outstanding payments are settled. Subsequently, title is determined by reference to the annual Stock Certificate and, in the case of sealed cases, to the rotation number marked on each case.
Limited liability
Lay & Wheeler and its Agents will accept no liability for their actions beyond those stipulated under relevant sections of the Sale of Goods Acts and Distance Selling Regulations. Whilst Lay & Wheeler will take every reasonable care in the storage of your investment wines, no liability will be accepted for deterioration which may occur through the natural processes to which all wines and their corks, however well cared for, are subject.
Other Terms and Conditions
In all other respects Lay & Wheeler’s standard conditions and terms of trade shall apply.
